That is a service-department story, not a legal standard. California’s Lemon Law contains no exception for premium marques, and the warranty Audi sold you does not have an asterisk.
Your Audi may qualify under the Song-Beverly Consumer Warranty Act if a substantial, warranty-covered defect survives a reasonable number of repair attempts, or if the vehicle has been out of service for 30 or more cumulative days. Those days do not need to be consecutive — and with parts on a Q8 e-tron or an RS model, they add up.
One point in Audi owners’ favor: Audi of America has NOT opted into California’s AB 1755 procedures. That means the traditional four-year statute of limitations applies, and it runs from when you discovered — or reasonably should have discovered — the defect, not from the date you bought the car. That is a meaningfully longer window than owners of GM, Ford, Stellantis, Hyundai or Kia vehicles get. It is not unlimited, but you likely have more time than you think.

How California's Lemon Law Works for Your Audi
California's Lemon Law (the Song-Beverly Act) protects you when a new, leased, or certified pre-owned Audi has a substantial defect that the manufacturer or dealer can't repair after a reasonable number of attempts — or when it's been out of service for 30 or more cumulative days.

How long do I have to file an Audi claim in California?
Longer than owners of many other brands. Audi has not opted into California’s AB 1755 procedures, so the traditional four-year statute of limitations applies — and it runs from when you discovered or should have discovered the defect, not from your purchase date. If a competitor told you the deadline is one year post-warranty, that rule does not apply to Audi.
The dealer says my Audi’s oil consumption is within spec. Is that the end of it?
No. “Within spec” is Audi’s standard, not California’s. If your engine consumes oil to a degree that impairs the vehicle’s use, value or safety and the dealer cannot fix it after a reasonable number of attempts, you may have a claim regardless of what the consumption test says.
My MMI screen keeps freezing. Is that substantial enough?
It can be. In a modern Audi, the center screen controls the climate system and the backup camera. When it goes dark, safety equipment goes with it. That is a defect that impairs use and safety — the statutory test — not a cosmetic annoyance.
Do software updates count as repair attempts?
Yes. If Audi applies a software fix for your defect and the defect returns, that is a failed repair attempt and it belongs in the file. Keep every service record, including remote updates.
