BMW’s service departments have a well-practiced way of describing defects as characteristics. A stability-control fault becomes “sport calibration.” An engine that drinks a quart of oil every thousand miles becomes “normal for a high-performance motor.” None of that survives contact with the Song-Beverly Act, which asks a much simpler question: does the defect impair the vehicle’s use, value or safety, and could BMW fix it?
Your BMW may qualify if a substantial, warranty-covered defect survives a reasonable number of repair attempts, or if the vehicle has been out of service for 30 or more cumulative days. Repeated recalls of the same system are particularly useful evidence — the 2025 X5 is subject to two separate electronic stability control recalls (24V104 and 24V697). When BMW has to address the same safety system twice, that is a record of failed repair in its own filings.
One point in BMW owners’ favor: BMW of North America has NOT opted into California’s AB 1755 procedures. That means the traditional four-year statute of limitations applies, and it runs from when you discovered — or reasonably should have discovered — the defect, not from the date you bought the car. That is a meaningfully longer window than owners of GM, Ford, Stellantis, Hyundai or Kia vehicles get. It is not unlimited, but you likely have more time than you think.

How long do I have to file a BMW claim in California?
Longer than most brands. BMW has not opted into California’s AB 1755 procedures, so the traditional four-year statute of limitations applies, running from when you discovered or reasonably should have discovered the defect. Owners of GM, Ford or Stellantis vehicles face a much tighter deadline. You likely have more time than you think — but not unlimited time.
The dealer says my BMW’s oil consumption is normal. Is it?
“Normal” is BMW’s word, not the statute’s. Excessive oil consumption has been documented across BMW’s turbocharged engines for years. If it impairs the vehicle’s use, value or safety and BMW cannot fix it after a reasonable number of attempts, you may have a claim regardless of what the consumption test allegedly shows.
My X5’s stability control keeps throwing faults. Does that matter?
It matters a great deal. The 2025 X5 is subject to two separate electronic stability control recalls. When a manufacturer recalls the same safety system twice, it is conceding on the record that the first fix did not work — which is exactly the evidence a lemon law claim is built on.
Do iDrive and software problems count?
They can. The center screen controls the climate system and the backup camera. When it goes dark, safety equipment goes with it — that is a defect that impairs use and safety, not a cosmetic complaint.
