Because Nissan North America opted into California’s AB 1755 procedures, the filing window on a Nissan claim is shorter than most owners realize: generally one year from your warranty’s expiration, and no later than six years from the vehicle’s original delivery date. That is materially tighter than the four-year rule that applies to manufacturers who did not opt in — and several competing firms still publish the four-year figure for Nissan. If your warranty has lapsed or is close to it, the clock is the first thing to check, not the last.
Nissan’s continuously variable transmission is the most litigated drivetrain defect in California. Shuddering, juddering, hesitation, overheating and outright failure have been documented across the Altima, Rogue, Sentra, Pathfinder and Murano for well over a decade. My Nissan’s CVT shudders. Is that a lemon?
It is the single most common Nissan lemon-law claim in California. If the transmission has been reprogrammed, rebuilt or replaced and the shudder has returned, you have a substantial defect that survived a reasonable number of repair attempts — which is the statutory test.
Nissan replaced my CVT and it failed again. What now?
That is the strongest version of the claim. A component that is replaced and fails again is precisely what the Lemon Law exists to remedy — the manufacturer has had its reasonable opportunity and the defect persists. You may be entitled to a buyback, replacement, or cash settlement.
Is there a deadline for a Nissan claim?
Yes, and it is shorter than the default rule. Does a software reprogram count as a repair attempt?
It does. If Nissan reflashes or reprograms the transmission to address your shudder and the shudder returns, that is a failed repair attempt and it belongs in your file. Keep the paperwork for every visit, however minor it seemed.
