Owners assume that paperwork is fatal. It is closer to the opposite. Every one of those visits is a documented attempt to repair a problem you reported — and a manufacturer that has had four cracks at a defect and still has not fixed it is not in a stronger position because its own technicians could not find it. It is in a weaker one. The vehicle is still broken; they simply failed to diagnose it.
So do not stop reporting a fault because the dealer keeps shrugging. Report it every single time. Get a repair order every single time, even when they write nothing was found. That stack of "could not duplicate" orders is not a record of your failure to prove anything — it is a record of theirs.
Why coastal cars fail in ways that are hard to reproduce
Salt air is corrosive, and the parts it reaches first are rarely the dramatic ones. It works on connectors, grounds, and wiring — the plumbing of a modern car's electrical system. A slightly corroded ground does not fail cleanly. It fails intermittently, in humidity, at temperature, over bumps.
That is precisely the failure mode a service department is worst at catching, because the car has to misbehave during the twenty minutes a technician has it. Meanwhile the driver, who experiences it three times a week, is told there is nothing wrong.
Modern vehicles make this worse, not better. When electrical faults reach the software — an infotainment head unit that reboots, a driver-assist system that disables itself, an EV that throws a charging fault and then clears it — the dealer's scan tool may show no stored code at all. None of this means the vehicle is fine. It means the defect is intermittent, and intermittent defects are still defects.
The 18,000-mile rule is not a deadline. Read this before you give up.
The most damaging myth in California lemon law is that you have 18 months or 18,000 miles to have a claim. You do not. That window is a *presumption* period — meet it, and a reasonable number of repair attempts is legally presumed. That is the entire effect.
The presumption is a shortcut, not a requirement. Song-Beverly does not say a manufacturer stops being liable at 18,000 miles. It says a manufacturer that cannot repair a warranty-covered defect after a reasonable number of attempts owes you a buyback or a replacement — and whether the number of attempts was reasonable is a question of fact, proven with your repair history. Most successful lemon law claims are built exactly that way, without leaning on the presumption at all.
This matters especially for the intermittent, hard-to-reproduce faults coastal cars are prone to, because those problems often take a long time to build a record. If you are past the window and the dealer has been chasing the same ghost for a year, you have lost a shortcut — not the claim.
What you are actually owed, and what it costs you to find out
A buyback refunds the purchase price plus incidental costs — taxes, registration, finance charges — minus a mileage offset for the use you got before the trouble started. That offset is computed from the miles driven before your *first* repair attempt (purchase price × those miles ÷ 120,000), which is another reason to report a problem the first time it happens rather than the fifth.
Where a manufacturer's failure to comply was willful, the law also allows a civil penalty of up to two times your actual damages (Civil Code § 1794(c)). That provision exists because the alternative — a manufacturer stringing an owner along until they give up — is exactly what the statute was written to stop.

The claim is not about the salt air itself — it is about a warranty-covered defect that the manufacturer cannot fix. Coastal conditions tend to surface electrical faults: corroded connectors and grounds cause intermittent warning lights, infotainment reboots, sensor faults, and charging errors that come and go. If a defect like that substantially impairs the vehicle's use, value, or safety and survives a reasonable number of repair attempts, it can support a claim regardless of what triggered it.
My problem only happens sometimes. Is an intermittent fault enough?
Intermittent is not the same as imaginary, and the law does not require a defect to be constant. What matters is whether it substantially impairs use, value, or safety, and whether the manufacturer failed to repair it after a reasonable number of attempts. Intermittent electrical and software faults are among the most common lemon law claims precisely because they are so hard for a dealer to fix.
I'm past 18 months / 18,000 miles. Is it too late?
No. That window is a presumption period, not a filing deadline. Meeting it gives you a legal shortcut — a reasonable number of repair attempts is presumed. Missing it costs you the shortcut and nothing else. The manufacturer's obligation to repurchase a vehicle it cannot fix does not expire at 18,000 miles, and most successful claims are proven on the repair history without relying on the presumption at all. Your actual filing deadline is a separate question that depends on your warranty and whether the manufacturer opted into AB 1755.
