What qualifies as a 'lemon' in California?
Under California's Lemon Law (Song-Beverly Act), a vehicle is considered a lemon if it has a substantial defect covered by warranty that the manufacturer or dealer cannot repair after a reasonable number of attempts, OR the vehicle has been out of service for repair for 30+ days.
Does the Lemon Law cover used cars?
Certified Pre-Owned (CPO) vehicles are typically covered because they come with manufacturer-backed warranties.
What can I get if my car is a lemon?
You may be entitled to a full refund (including down payment, monthly payments, registration fees, and incidental costs), a replacement vehicle of equal value, or a cash-and-keep settlement. The manufacturer must also pay your attorney fees.
How many repair attempts are required?
There's no magic number under California law. In California, a vehicle is presumed to be a lemon if, in the first 18 months or 18,000 miles (whichever comes first), (1) the same problem persists after 4+ repair attempts, (2) there are 2+ attempts for a safety defect that could cause death or serious injury, or (3) the vehicle has been out of service for 30+ cumulative days. However, every case is unique and the majority of successful lemon law cases are cases that fall outside of the presumption.
What if the dealer says my problem is 'normal'?
Manufacturers often try to dismiss legitimate defects as 'normal operating characteristics.' If your vehicle doesn't perform as expected or advertised, the defect may still qualify under the Lemon Law. We can evaluate whether you have a valid claim.
Do I have to go back to the dealer for more repairs?
Before filing a lemon law claim, you should give the manufacturer a reasonable opportunity to fix the problem. However, you don't have to continue bringing your car in indefinitely. Once you've met the threshold, you can pursue your claim.
