The EV capital has an EV lemon problem
Santa Clara County has one of the highest electric-vehicle adoption rates in the United States, and that changes what a lemon looks like here. The defects San Jose drivers bring us are rarely a knocking engine. They are charging systems that fail intermittently, batteries that lose range far beyond normal degradation, infotainment and driver-assist software that freezes or behaves unpredictably, and drivetrains that throw fault codes no service center can chase down.
California's Song-Beverly Act does not care whether the defect is mechanical or digital. A software fault that substantially impairs the use, value, or safety of the vehicle is as much a lemon-law defect as a failed transmission — and every service visit for it, including visits that end with 'we pushed an update, try it now,' belongs in your repair history. Owners of EVs are often talked into treating repeated software fixes as normal. Under the statute, they are repair attempts.
One EV-specific trap is worth flagging: range loss. Manufacturers will say battery degradation is normal wear, and some of it is. But a battery that loses a large share of its rated range early, or a battery-management system that repeatedly faults, throttles charging, or strands the car, is a warranty defect — and EV batteries carry long federal-mandated warranties. Do not let 'that's just how EVs are' talk you out of a claim.
Stevens Creek, Capitol Expressway, and where San Jose's lemons come from
San Jose buys its cars in two famous clusters: the Stevens Creek Boulevard auto row on the city's west side and the Capitol Expressway auto mall in the southeast. Between them, they sell and service an enormous share of the South Bay's new and certified pre-owned vehicles — which means they also generate a large share of its lemon-law repair histories.
If your vehicle keeps returning to one of these service departments for the same problem, the paperwork from each visit is the raw material of your claim. Read every repair order before you leave: confirm the complaint you reported is written on it, keep your copy, and note the days the car sat waiting. Thirty or more cumulative days out of service for warranty repair is itself a path to relief under California law, separate from the repeated-repair-attempt route.
The same rules cover new, leased, and certified pre-owned vehicles bought from a dealer with the balance of a warranty. And if the manufacturer cannot fix a substantial defect after a reasonable number of attempts, it owes a repurchase or replacement — with your attorney fees paid on top (Civil Code § 1794(d)).
