The rule nobody tells you about: 30 days out of service
Most people think a lemon law claim is only about how many times a car went in. There is a second route that gets overlooked, and it is often the easier one to prove: a vehicle that has been out of service for repair of warranty defects for a cumulative total of more than 30 days.
Cumulative is the key word. It is not thirty days in a row. It is every day the car sat at the dealer waiting on a diagnosis, a part, or a technician, added together across every visit. In an era of long parts backorders — especially on EVs and newer software-heavy vehicles — owners cross that line without realizing it.
So count the days. Go back through your repair orders and add up every day the vehicle was in the shop's possession. If that total is climbing past thirty, you may have a stronger claim than you think, even if the number of individual visits seems modest.
What the 805, the 5, and the border queues do to a car
South Bay driving is unusually hard on a vehicle in one specific way: sustained idling. Long waits in border-crossing queues, plus stop-and-go on the 805 and the 5, mean an engine or an EV thermal system spends a great deal of time working with almost no airflow over it.
That is the condition where cooling systems, air-conditioning compressors, and EV battery thermal management get tested hardest — and where a marginal component tends to show itself. Transmissions that shudder in low-speed creep, air conditioning that fades in a queue, EVs that lose range or throw thermal faults in traffic: these are ordinary complaints down here.
None of that means every vehicle fails. It means when a defect exists, this is where it surfaces — and if the dealer has had it three or four times for the same complaint, the pattern is worth a call.

No. That window is a presumption period, not a filing deadline. Meeting it gives you a legal shortcut — a reasonable number of repair attempts is presumed. Missing it costs you the shortcut and nothing else. The manufacturer's obligation to repurchase a vehicle it cannot fix does not expire at 18,000 miles, and most successful claims are proven on the repair history without relying on the presumption at all.
