If the remedy is not available yet, or your dealer cannot tell you when the parts will arrive, ask for that in writing. A manufacturer that cannot repair your vehicle within a reasonable time is a manufacturer with a lemon law problem.

Your rights

A do-not-drive order is the clearest lemon law fact there is

A stop-drive recall is the most serious instruction a manufacturer can issue. Volvo is telling you that your vehicle is too dangerous to operate at all.

You do not need to argue about whether the defect substantially impairs the use of your vehicle. The manufacturer has removed the use of your vehicle entirely, and put it in writing. Every day the car sits undriveable is a day it is out of service — and California counts those days.

If you are still making payments on a car you have been ordered not to drive, that is precisely the harm the Song-Beverly Act exists to remedy.

A recall is not automatically a lemon. It is the manufacturer admitting a defect and offering to fix it free — that is the system working. A lemon law claim arises when the fix fails, the fix never comes, or the defect has already taken the use of your vehicle away from you.

What to do now

Do not drive the vehicle. Arrange a tow — the manufacturer should pay for it, and if it will not, keep the receipt.
Keep the stop-drive notice.
Demand a loaner or rental in writing, and keep every receipt if you have to pay yourself.
Log every single day the vehicle has been undriveable. Those days go straight to the 30-day threshold.
Do not let the manufacturer run out the clock while you wait for a part.
