GMC Hummer EV Lemon Law

Talk to a GMC lemon law attorney — your GMC Hummer EV may qualify for a buyback, replacement, or cash settlement.

If your GMC Hummer EV has lost drive power, thrown a high-voltage warning, refused to go to Ready, or been slated for a full battery-pack replacement, you may have a California lemon — and on a six-figure EV, that can mean a substantial buyback.

The Defect

The Hummer EV battery and software problems

GMC recalled 2022 Hummer EV pickups (NHTSA 22V771; GM number N222380031) built between November 2021 and September 2022 because water can accumulate in the high-voltage battery pack and cause a loss of drive power. The root cause was improperly prepared battery-pack flanges that kept the urethane sealant from adhering; GM documented vehicles that would not start and one that lost propulsion while driving. The remedy is not a small fix — it involves replacing the entire high-voltage battery pack.

Owners have also reported software-driven failures: a battery control module that gets stuck in a start-up ("commissioning") state so the truck won't go to Ready or shows a persistent high-voltage system warning until it is reprogrammed, "propulsion power is reduced" messages, charging faults, and a separate taillight software problem that can leave the rear lights inoperative or stuck illuminated. As a first-generation electric truck, the Hummer EV has had more than its share of these growing pains — and they apply to the Hummer EV Pickup and the Hummer EV SUV alike.

A Hummer EV that keeps losing drive power, spends weeks waiting on a battery pack, or can't be reliably driven is a strong lemon candidate. If the problem can't be fixed after a reasonable number of repair attempts, or the vehicle is out of service for an extended time, California's Lemon Law may entitle you to a buyback, replacement, or cash settlement — with GM paying your attorney fees. Because of the Hummer EV's price, a buyback can be one of the largest in the lemon world.

Known Issues

Commonly Reported GMC Hummer EV Problems

Water intrusion in the high-voltage battery pack → loss of drive power (NHTSA 22V771)
Full high-voltage battery-pack replacement as the recall remedy
Battery control module stuck in a start-up ("commissioning") state — won't go Ready
"Propulsion power is reduced" and persistent high-voltage system warnings
Taillight software failure — rear lights inoperative or stuck illuminated
Charging faults, software glitches, and extended time out of service waiting on parts

Not every GMC Hummer EV is affected. Any substantial, warranty-covered defect that can't be fixed after a reasonable number of attempts — or that keeps your vehicle out of service — may support a claim.

Your Rights

Is Your GMC Hummer EV a Lemon?

A recall is not automatically a lemon — it's the manufacturer acknowledging a defect and offering a free repair. California's Lemon Law (the Song-Beverly Act) comes into play when a substantial defect can't be fixed after a reasonable number of attempts, or when your Hummer EV has been out of service for 30 or more cumulative days.

If your GMC Hummer EV qualifies, you may be entitled to a buyback (a refund of what you've paid, minus a mileage offset), a replacement vehicle, or a cash-and-keep settlement — and GMC pays your attorney fees on a successful claim, so pursuing your case costs you nothing out of pocket.

Common Questions

GMC Hummer EV Lemon Law FAQs

Was my GMC Hummer EV recalled?

2022 Hummer EV pickups built between November 2021 and September 2022 were recalled (NHTSA 22V771) over water intrusion in the high-voltage battery pack that can cause a loss of drive power, with a full battery-pack replacement as the remedy. Additional software updates address 2022–2024 Hummer EVs (battery control module and taillight issues). Confirm your VIN at nhtsa.gov/recalls.

My Hummer EV lost power or won't go Ready — is it a lemon?

Not automatically. But if the battery or software problem can't be fixed after a reasonable number of repair attempts, or your Hummer EV is out of service for an extended time, you may have a California lemon law claim — potentially a buyback, replacement, or cash settlement, with GM paying your attorney fees.

The dealer wants to replace my whole battery pack — what does that mean for my claim?

A full high-voltage battery-pack replacement is a major repair, and the long out-of-service time that often comes with it can strengthen a lemon claim. Keep every repair order and loaner record, and get a free case review — repeated attempts or extended downtime are exactly what the Lemon Law addresses.

What can I recover for a defective Hummer EV?

Potentially a buyback (a refund minus a mileage offset), a replacement, or a cash-and-keep settlement — plus your attorney fees paid by GM. Given the Hummer EV's six-figure price, the buyback value can be substantial.
