Lemon Law & Personal Injury Lawyers in San Bernardino

Inland Empire drivers put miles on a car faster than almost anyone in California — which means a defective vehicle burns through its warranty window faster too. If your car keeps going back to the dealer for the same problem, you may be entitled to a buyback, and the manufacturer pays our fees.

Serving Your Community

Representing San Bernardino Drivers

If your new, leased, or certified pre-owned vehicle has been in the shop repeatedly for the same defect, California's Song-Beverly Act may entitle you to a buyback, a replacement, or a cash settlement — at no out-of-pocket cost, because a manufacturer that loses pays your attorney fees (Civil Code § 1794(d)).

San Bernardino sits where the 10, the 215, and the 210 meet, at the foot of the Cajon Pass. Long commutes toward Los Angeles and Orange County are normal here, and that has a specific legal consequence most drivers never hear about: mileage, not time, is often what closes your window.

Our office is in Woodland Hills — we are not going to pretend otherwise. What we do offer is free phone and video consultations, and representation for San Bernardino clients without you driving to the Valley. Every case gets an attorney from day one.

Why Inland Empire drivers run out of miles before they run out of time

California's lemon law presumption applies within the first 18 months or 18,000 miles, whichever comes first. For someone driving a few miles to work, 18 months usually arrives first. For a San Bernardino commuter running the 10 or the 215 toward Los Angeles every day, 18,000 miles can arrive long before the 18 months do — sometimes in well under a year.

This matters because it is the phrase "whichever comes first" that does the damage. Drivers assume they have a year and a half. What they actually have, out here, is a mileage budget — and they spend it fast.

Here is the part that gets misunderstood constantly, and it matters more than anything else on this page: the 18-month / 18,000-mile window is NOT a deadline, and blowing past it does not end your claim. It is a *presumption* period — a legal shortcut. Meet it, and a reasonable number of repair attempts is presumed. That is all it does.

The presumption is a bonus, not a requirement. California's Song-Beverly Act does not say a manufacturer is only liable inside 18 months or 18,000 miles. It says a manufacturer that cannot repair a warranty defect after a reasonable number of attempts owes you a buyback or replacement — and what counts as 'reasonable' is a question of fact, proven with your repair history. Most successful lemon law claims are built exactly that way, without ever relying on the presumption at all.

So if you are a high-mileage Inland Empire driver who crossed 18,000 miles months ago, do not talk yourself out of a case. You have simply lost a shortcut, not the claim. Plenty of vehicles are bought back well past that window because the repair record speaks for itself. (Your actual filing deadline is a separate question that depends on your warranty and whether the manufacturer opted into California's AB 1755 — that one is worth asking about rather than guessing.)

The practical takeaway is simple: report the problem early, in writing, and keep every repair order. The repair history is the case — with or without the presumption.

What the heat and the grades actually do to a car out here

Inland Empire summers routinely run well past 100 degrees, and that is not a trivia fact — it is a mechanical stress test. Air-conditioning compressors, cooling systems, and the thermal-management systems on electric vehicles all work hardest in exactly these conditions, which is when owners tend to discover they were not built to cope. Infotainment screens and electronics fail in heat too.

The terrain adds a second load. Climbing toward the Cajon Pass, or working up the grades on the 210, puts sustained strain on a transmission and a cooling system in a way that flat-city driving never does. A transmission that shudders under load, or a vehicle that overheats on a climb, tends to show itself here first.

None of this means every vehicle fails — most do not. It means that when a defect exists, San Bernardino conditions surface it, and they surface it hard. If the dealer has had your car three or four times for the same air-conditioning failure, the same overheating, or the same drivetrain fault, that pattern is worth a conversation.

What a buyback is worth — and why your mileage decides it

In a successful buyback, the manufacturer refunds what you paid — the purchase price plus incidental costs like taxes, registration, and finance charges — minus one deduction: a mileage offset for the use you got out of the car before the trouble started.

That offset is calculated from the miles you drove *before your first repair attempt*, using a specific formula: purchase price × those miles ÷ 120,000. Read that again if you are a high-mileage driver, because it is the whole ballgame. The offset is not based on the miles on the car today. It is based on the miles you had racked up when you first brought the problem in.

That is why waiting hurts Inland Empire drivers more than most. A commuter who ignores a defect for six months and 12,000 miles before saying anything has permanently increased the deduction from their own refund. Bringing it in early — and getting it documented — protects the value of the claim.

You do not pay us, and you do not have to come to us

California's lemon law includes a fee-shifting provision: when a manufacturer loses, it pays the consumer's attorney fees (Civil Code § 1794(d)). That is why a legitimate lemon law firm does not ask you for money up front, and why the manufacturer's own lawyers know a represented consumer is a different proposition from an unrepresented one.

Our office is in Woodland Hills, not San Bernardino, and we would rather say so than pretend to a storefront we do not have. In practice it changes very little: the consultation is free and happens by phone or video, we handle the manufacturer directly, and most lemon law claims resolve without the client ever setting foot in a courtroom.

If you want to know whether you have a case, the fastest thing you can do is gather your repair orders and call. It costs nothing to find out.

Common Questions

San Bernardino — Frequently Asked Questions

I drive a lot for work. Does high mileage hurt my lemon law claim?

It affects two things. First, the 18,000-mile half of the presumption window can arrive long before the 18-month half — and it is 'whichever comes first.' Second, the buyback mileage offset is calculated from the miles you drove before your FIRST repair attempt, so the longer you wait to report a defect, the more is deducted from your refund. High mileage does not disqualify you, but it does make reporting early significantly more valuable.

Do I have to drive to Woodland Hills to hire you?

No. Our office is in Woodland Hills — we do not have a San Bernardino office and will not pretend to. Consultations are free and handled by phone or video, we deal with the manufacturer directly, and most lemon law claims resolve without the client appearing in court at all.

My air conditioning has failed twice in the summer heat. Is that a lemon?

It can be. The test is whether a warranty-covered defect substantially impairs the vehicle's use, value, or safety and has not been fixed after a reasonable number of repair attempts. In Inland Empire summers, a failing air conditioner is not a cosmetic annoyance — and repeated failures of the same system are exactly the pattern the lemon law was written for. Bring your repair orders and we will tell you honestly.

I'm past 18 months / 18,000 miles. Am I out of luck?

No. This is the single most common misunderstanding in California lemon law, and it talks people out of good claims every day. The 18-month / 18,000-mile window is a presumption period, not a deadline. Meeting it gives you a legal shortcut — a reasonable number of repair attempts is presumed. Missing it costs you the shortcut and nothing else. The manufacturer's obligation to repurchase a vehicle it cannot fix does not expire at 18,000 miles. Most successful lemon law claims are proven on the repair history itself, without relying on the presumption at all, and vehicles are bought back well past that window all the time. Your actual filing deadline is a separate question that depends on your warranty and whether the manufacturer opted into AB 1755 — ask, don't assume.

What does a San Bernardino lemon law attorney cost?

Nothing out of pocket. California's Song-Beverly Act requires a manufacturer that loses to pay the consumer's attorney fees (Civil Code § 1794(d)). The case evaluation is free and there is no obligation.

Do you have an office in San Bernardino?

Our office is in Woodland Hills, and we represent clients in San Bernardino and throughout California. Consultations are free and available by phone or video, so you don't need to travel to get started.

How much does it cost to hire a lemon law or personal injury lawyer in San Bernardino?

Nothing out of pocket. In California lemon law cases, the manufacturer pays your attorney fees when you win. Personal injury cases are handled on contingency — no fee unless we recover compensation for you.
