Subaru Crosstrek & Forester Hybrid Fire Recall: Your California Lemon Law Rights

By Arvin MousaviUpdated June 23, 20264 min read

Subaru has recalled 69,153 model year 2026 Crosstrek Hybrid and 2025 Forester Hybrid vehicles (NHTSA recall 26V106000, Subaru reference WRD-26) over a fuel-system defect that can raise fire risk when the tank is near full. Here's what the recall covers, what to do, and when a recall like this can become a California lemon law claim.

What the recall covers

When the fuel tank is near full, rising ambient temperature can cause the fuel to expand and spill from the filler neck because of an insufficient seal on the fuel cap. A fuel leak near an ignition source increases the risk of a fire, which is why Subaru advises parking outside and keeping the tank no more than about half full until the repair is done.

What owners should do now

  • Until repaired, park outside and away from structures, and keep the fuel level around 50% or less, per Subaru's guidance.
  • Watch for your Subaru letter and schedule the free fuel cap gasket replacement.
  • Confirm your VIN at nhtsa.gov/recalls or subaru.com.
  • Keep your recall letter and every repair order.

When this recall can become a lemon

A recall isn't automatically a lemon — Subaru will replace the fuel cap gasket for free. But if the repair is delayed, doesn't resolve the fuel leak, or your Crosstrek or Forester Hybrid has other unrepaired warranty defects, California's Lemon Law may entitle you to a buyback, replacement, or cash settlement, with the manufacturer paying your attorney fees.
